The seller is ITALO, an independent Paris-based design and bicycle project dedicated to sculptural bicycle objects, modular accessories, limited editions, and critical approaches to urban mobility.

These Terms and Conditions apply to all online sales, preorders, reservations, and purchases of products belonging to the Larmes de Sirène line concluded between ITALO and any Customer acting as a consumer for personal, non-professional purposes.

They apply in particular to LDS_01_RAW, unless a specific product page, invoice, or written communication from ITALO provides additional product-specific information.

They prevail over any other general or specific conditions not expressly accepted by ITALO in writing. ITALO may amend these Terms and Conditions at any time. The applicable version is the one in force on the date of the Order.

These Terms and Conditions are governed by French law, including the relevant provisions of the French Consumer Code and the French Civil Code applicable to distance selling, pre-contractual information, delivery, right of withdrawal, and legal guarantees.

Nothing in these Terms and Conditions excludes or limits mandatory rights granted to consumers under French or European Union consumer protection law.

Larmes de Sirène is a line of sculptural modules designed by ITALO for installation on selected bicycle frames. The pieces are conceived as design objects, anti-accessories, narrative objects, and material interventions rather than conventional bicycle accessories.

Products in the Larmes de Sirène line may be produced in limited quantities, small series, editions, drops, prototypes, raw versions, finished versions, or artist collaborations.

The Customer acknowledges that products from the Larmes de Sirène line are not structural bicycle components. They are not braking components, steering components, frame reinforcements, child safety devices, personal protective equipment, or certified safety components.

LDS_01_RAW is the first raw module of the Larmes de Sirène line. It is designed for installation around the junction of the top tube and the seat tube on certain vintage steel bicycle frames.

LDS_01_RAW is produced using HP Multi Jet Fusion additive manufacturing in Nylon PA12, with a raw, matte, mineral-like finish. It may also function as a concealed support for a compatible rear light where indicated in the product description.

Surface texture, minor visual irregularities, powder traces, slight marks, dimensional tolerances, and batch-to-batch variations are inherent to the raw additive manufacturing process and form part of the aesthetic identity of LDS_01_RAW. These characteristics are not considered defects provided they do not prevent normal use in accordance with the product description.

Compatibility depends on the specific product, the bicycle frame, tube diameter, tube shape, frame geometry, paint thickness, frame age, previous repairs, previous modifications, and manufacturing tolerances.

LDS_01_RAW is designed primarily for vintage European steel bicycle frames, especially road, city, and light touring bicycles from the 1980s and 1990s, using approximately 25.4 mm tubing standards.

Some older French frames or non-standard frames may present dimensional variations. In such cases, LDS_01_RAW may fit differently or may leave a visible gap at the point of contact.

The Customer is responsible for verifying compatibility before purchasing and before installing the Product. ITALO does not guarantee universal compatibility with all bicycles.

Unless expressly stated otherwise, Larmes de Sirène products are designed for non-permanent installation. No drilling, welding, cutting, glue, permanent bonding, or structural modification of the bicycle frame is required or recommended.

The Customer acknowledges that installation is carried out under their own responsibility. Incorrect installation may damage the bicycle, paint, finish, or Product.

The Product must be installed in a way that does not interfere with brake cables, gear cables, seatpost insertion, seat clamp function, wheel clearance, pedalling, lighting visibility, steering, braking, or the rider's movement.

LDS_01_RAW is intended for ordinary urban and leisure bicycle use only. It is not intended for racing, off-road riding, jumps, freestyle use, bikepacking under heavy load, professional use, sport competition, or high-impact cycling activity.

If the Customer is unsure about installation, they should consult a qualified bicycle mechanic before use.

Certain Larmes de Sirène products may include a concealed support designed to accommodate a specific bicycle light model, where indicated in the relevant product description.

LDS_01_RAW may include a support designed to accommodate the Knog Plus Rear Bike Light. Unless expressly stated otherwise, the light itself is not included.

ITALO does not manufacture the light and is not responsible for its independent functioning, battery life, waterproofness, visibility, certification, or compliance with road traffic regulations. The Customer remains solely responsible for ensuring that their bicycle lighting complies with applicable local road safety laws.

Orders are placed exclusively through the Website or any official sales channel expressly indicated by ITALO. The Customer is responsible for providing accurate and complete information, including name, billing address, shipping address, email address, and payment details.

ITALO may refuse or cancel an Order in the event of incorrect customer information, payment failure, suspected fraud, technical error, stock unavailability, pricing error, or abnormal order conditions.

Certain Larmes de Sirène products may be offered as preorders, reservations, limited drops, or threshold-based production campaigns. In such cases, the Customer acknowledges that the Product may not be immediately available, production may begin only after a minimum quantity is reached, delivery dates are indicative, and visual or technical details may evolve within reasonable limits.

Where a preorder or reservation is cancelled by ITALO, the Customer will receive a full refund of any amount effectively paid. If ITALO uses a deferred payment or card authorisation system, the Customer will be informed before final payment is captured.

Prices are indicated in euros (€). Unless otherwise stated, prices do not include shipping costs, customs duties, import taxes, or additional local charges. The total price, including applicable taxes and shipping costs, will be indicated before final confirmation of the Order.

Payment is made through the secure payment methods available on the Website. ITALO may use third-party payment providers, including Stripe. The Customer guarantees that they are authorised to use the selected payment method.

Payment information is processed by the payment provider according to its own security standards. ITALO does not store full payment card details.

Products are delivered to the address provided by the Customer at the time of the Order. Delivery times are estimates and may vary depending on production, stock, carrier availability, destination, customs procedures, or force majeure events.

Unless otherwise agreed, ITALO shall deliver the Product within the legal timeframe applicable to online sales. The Customer must ensure that the delivery address is complete and accurate.

Risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, physically receives the Product.

The Customer must inspect the package and Product upon delivery. If the package is visibly damaged, opened, crushed, or incomplete, the Customer should make reservations with the carrier and inform ITALO as soon as possible.

For online purchases made by consumers, the Customer has a legal right to withdraw from the contract within 14 days from the day on which the Customer, or a third party designated by the Customer other than the carrier, receives the Product.

To exercise the right of withdrawal, the Customer must notify ITALO by email at italomecano@gmail.com using the withdrawal form below or any clear written statement expressing the wish to withdraw.

If the Customer validly exercises the right of withdrawal, ITALO will refund all payments received from the Customer, including standard delivery costs where legally required. ITALO may withhold the refund until it has received the Product back or until the Customer has provided proof of return shipment, whichever occurs first.

Return shipping costs are borne by the Customer, unless ITALO agrees otherwise or unless the Product is defective or non-conforming.

The Product must be returned unused, undamaged, complete, clean, with all accessories, if any, and in its original or equivalent protective packaging. Installation on a bicycle, visible marks caused by installation, scratching, modification, sanding, cutting, painting, gluing, or any alteration may reduce or eliminate the refund, subject to applicable law.

Products made to the Customer's specifications or clearly personalised may be excluded from the right of withdrawal where legally permitted. Standard LDS_01_RAW pieces are not automatically excluded from withdrawal merely because they are sold in limited quantities.

ITALO is liable for defects of conformity under the conditions provided by French consumer law. A Product is conforming if it corresponds to the description provided, is fit for the usual purpose of goods of the same type, and presents the qualities that the Customer may legitimately expect given the nature of the Product and the statements made by ITALO.

The legal guarantee does not cover normal wear and tear, damage caused by incorrect installation, damage caused by misuse, damage caused by incompatible frames, damage caused by shocks or accidents, voluntary modification of the Product, cosmetic variations inherent to raw additive manufacturing, or use contrary to the instructions provided.

The Customer may also benefit, where applicable, from the legal warranty against hidden defects under French civil law. Unless expressly stated in writing, ITALO does not provide any commercial warranty beyond the mandatory legal guarantees.

ITALO shall not be liable for damage resulting from incorrect installation, use on an incompatible bicycle, failure to inspect the Product before riding, interference with bicycle components, modification of the Product, use outside the intended purpose, accident, crash, fall, shock, improper maintenance, third-party installation, or non-compliance with applicable traffic and safety rules.

Larmes de Sirène products, including LDS_01_RAW, must never compromise the safety, visibility, braking, steering, structural integrity, or roadworthiness of the bicycle. The Customer remains responsible for ensuring that their bicycle remains safe and compliant with applicable laws after installation.

Nothing in these Terms and Conditions excludes or limits ITALO's liability where such exclusion or limitation is prohibited by law, including liability for legal guarantees owed to consumers.

The Product should be cleaned gently with a soft cloth and mild soap if necessary. The Customer must not use aggressive solvents, heat guns, open flames, sanding tools, drilling tools, or chemical treatments unless expressly approved by ITALO.

Exposure to heat, prolonged UV light, heavy mechanical stress, or chemicals may alter the Product's appearance or mechanical behaviour.

All designs, shapes, files, drawings, models, photographs, videos, texts, graphics, names, concepts, and visual identities associated with ITALO, Larmes de Sirène and LDS_01_RAW are protected by intellectual property rights.

The purchase of a Product does not transfer any intellectual property rights to the Customer. The Customer is prohibited from copying, scanning, moulding, reverse engineering, reproducing, selling copies, sharing 3D files, using the design commercially, or creating derivative products without written authorisation.

The Customer may resell the physical Product they have lawfully purchased, subject to applicable law. However, resale must not suggest any official partnership, authorisation, certification, or affiliation with ITALO unless expressly authorised in writing.

ITALO processes personal data necessary for order management, payment, delivery, customer service, legal compliance, and communication. Personal data may include name, email address, billing address, shipping address, order history, and payment-related information.

Payment data is processed by third-party payment providers. A separate Privacy Policy should be made available on the Website in accordance with applicable data protection law, including the GDPR.

ITALO shall not be liable for failure or delay in performing its obligations where such failure or delay results from an event beyond its reasonable control, including natural disasters, strikes, transport disruptions, supplier failures, customs delays, pandemics, fire, war, cyberattack, public authority decisions, or manufacturing interruptions.

For any complaint, question, return request, compatibility issue, or legal guarantee claim, the Customer may contact ITALO at italomecano@gmail.com.

The Customer should include the order number, name, description of the issue, photographs if relevant, and any supporting information. ITALO will make reasonable efforts to respond within a reasonable timeframe.

In accordance with French consumer law, the Customer may have access to a consumer mediation mechanism in the event of an unresolved dispute with ITALO. Before referring the matter to a mediator, the Customer must first contact ITALO in writing to attempt an amicable resolution.

These Terms and Conditions are governed by French law. In the event of a dispute, the parties shall first attempt to resolve the matter amicably. Failing amicable resolution, the dispute shall be submitted to the competent French courts, subject to any mandatory consumer protection rules that may grant the Customer the right to bring proceedings before another competent court.
